These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Digital Macaroni ("Company," "we," "us," or "our"), the owner and operator of the Ask Kazmo application, available as a web application and as mobile applications for iOS (Apple App Store) and Android (Google Play) (collectively, the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Ask Kazmo is a personalized astrology and daily ritual application that provides AI-generated content including daily horoscope summaries, card draws, natal chart interpretations, and a limited voice-based conversational experience ("Kazmo"). The App is designed for entertainment and personal reflection purposes only.

The App uses astronomical calculation tools for birth chart data. All interpretive, conversational, and narrative content generated by Kazmo is produced by artificial intelligence and is intended solely for entertainment.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18 (or the age of legal majority in your jurisdiction), you may use the App only with the consent and involvement of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements and have the legal capacity — or the consent of a parent or guardian — to enter into these Terms.

3. Account Registration and User Data

To use the App, you must provide your birth date, birth time, and birth location (collectively, "Birth Data") to enable chart calculations. You agree to provide accurate information. We are not responsible for inaccurate readings resulting from incorrect Birth Data provided by you.

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

4. Subscription, Billing, and Pricing

New users can ask up to three (3) questions for free to try Ask Kazmo. After that, continued access to the App requires a paid subscription or day pass. Current pricing — including our subscription plans and one-time day passes — is shown on our pricing page and may be updated from time to time. Existing subscribers will retain their locked rate as described at the time of enrollment. Prices for subscriptions purchased through the Apple App Store or Google Play may be higher than on our website to account for the platform fees charged by Apple and Google.

How you are billed: Subscriptions purchased on our website are processed by Creem, our Merchant of Record, and billed on a recurring basis. Subscriptions purchased through the Apple App Store or Google Play are billed by Apple or Google through your store account and are subject to their terms.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled beforehand. By subscribing, you authorize the applicable biller to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time, effective at the end of the current billing period. For website subscriptions, cancel through your account settings. For Apple App Store or Google Play subscriptions, you must cancel through your Apple or Google account settings — cancelling within the App alone will not stop store billing. No partial refunds are issued for unused days within a billing period.

Refunds: All subscription fees are non-refundable except where required by applicable law. Refunds for purchases made through the Apple App Store or Google Play are handled by Apple or Google under their respective policies.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Use automated systems, bots, or scrapers to access the App
• Reproduce, distribute, or resell any content generated by the App without our express written consent
• Attempt to circumvent any subscription or access controls
• Harass, abuse, or harm others using content from the App

6. Intellectual Property

All content, design, card artwork, text, audio, visual elements, and software comprising the App are the exclusive property of Digital Macaroni or its licensors. Nothing in these Terms grants you ownership rights in any App content. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes.

The collectible card artwork, card names, and associated categories are proprietary to the Company. You may not reproduce, distribute, or exploit card assets outside of your personal use within the App.

7. AI-Generated Content Disclaimer

Content generated by Kazmo, including but not limited to horoscope readings, natal chart interpretations, card descriptions, and conversational responses, is produced by artificial intelligence. Such content:

• Is generated for entertainment purposes only
• Does not constitute professional advice of any kind
• May be inaccurate, incomplete, or not applicable to your personal circumstances
• Should not be relied upon for financial, medical, legal, psychological, or life decisions

We make no representations or warranties regarding the accuracy, reliability, or fitness of AI-generated content for any particular purpose.

8. Conversation Data and Retention

Conversations within the App are retained for up to thirty (30) days to enable cross-referencing within your active sessions. After thirty (30) days, conversation data is automatically deleted. Conversation summaries associated with your collectible cards are retained as part of your card collection. By using the App, you acknowledge and accept this data handling approach.

We reserve the right to process and analyze anonymized, aggregated usage data to improve the App and our services.

9. Third-Party Services

The App uses third-party services including AI model providers and payment processors. Your use of the App is subject to the applicable terms and privacy policies of these third-party providers. We are not responsible for the practices of third-party services.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL MACARONI DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY OF ANY CONTENT GENERATED BY THE APP.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL MACARONI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Digital Macaroni and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Sheridan County, Wyoming, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or by email. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

15. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately.

16. Apple App Store and Google Play

If you download or use the App through the Apple App Store or Google Play, the following additional terms apply and, in case of conflict with the rest of these Terms, control with respect to that store:

• These Terms are concluded between you and Digital Macaroni only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content.
• Your license to use the App is limited to use on a device that you own or control, as permitted by the applicable App Store or Google Play terms.
• Apple and Google have no obligation to furnish any maintenance or support services for the App.
• To the maximum extent permitted by law, Apple and Google have no warranty obligation with respect to the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility.
• Apple and Google are not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or privacy law.
• Apple and Google are not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes that third party's intellectual property rights.
• Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
