Digital Macaroni ("we," "us," or "our") operates Ask Kazmo, available as a web application and as mobile applications for iOS (Apple App Store) and Android (Google Play) (collectively, the "App"). This Privacy Policy explains what personal information we collect, how we use and share it, how long we keep it, and the rights you have over it. It applies to all versions of the App.
Please read this policy together with our Terms of Service. If you do not agree with this policy, please do not use the App.
1. Information We Collect
Birth Data (sensitive). When you register, you provide your birth date, birth time, and birth location. We use this to calculate your natal chart and to generate your personalized astrological content. Because this information can be considered sensitive, we collect and process it only with your consent, which you provide when you create your account and submit this information.
Account Information. Your email address and any credentials used to access your account. Your email is also how you sign in.
Payment Information. When you purchase a subscription, payment is handled by our third-party payment providers (see "Payments" below). We do not collect or store your full payment card number on our servers.
Conversation Data. The questions you ask Kazmo and the responses you receive. To produce a response, the content of your conversation and the relevant parts of your chart are sent to our AI provider (see "AI Features" below).
Card Collection Data. Ask Kazmo includes a collectible-card feature. Short summaries derived from your conversations may be associated with the cards in your collection and retained as part of your account so your collection persists over time.
Usage Data. Information about how you use the App, such as features accessed, session duration, card draws, and question usage. Where possible this is collected in aggregated or de-identified form.
Device and Technical Data. Device type, operating system, browser type, mobile network/carrier, app version, language settings, approximate (non-precise) location derived from IP, and IP address, collected for security, fraud prevention, analytics, and optimization.
2. How We Use Your Information
We use the information we collect to:
- Calculate your natal chart and generate your personalized horoscope and Kazmo conversational content
- Provide, maintain, personalize, and improve the App and its features
- Process your purchases and manage your subscription
- Communicate with you about your account, updates, and support
- Analyze usage to understand and improve the user experience
- Detect, prevent, and address security incidents, fraud, or abuse
- Comply with our legal obligations and enforce our terms
3. Legal Bases for Processing (EEA, UK, and Switzerland)
If you are in the European Economic Area, the United Kingdom, or Switzerland, we process your personal data on the following legal bases:
- Performance of a contract — to provide the App you have signed up for, including calculating your chart and delivering your content.
- Consent — for your sensitive birth data, for non-essential analytics, and for marketing communications. You may withdraw consent at any time.
- Legitimate interests — to secure, maintain, and improve the App and prevent fraud and abuse, where these interests are not overridden by your rights.
- Legal obligation — to comply with applicable laws and lawful requests.
4. AI Features
Kazmo's conversational responses are generated using a third-party AI model provider. To generate a response, we send the relevant content of your conversation together with the relevant elements of your chart to this provider. We do not use your conversations to train our own models, and our AI provider does not use the data we send to train its models. The provider temporarily retains this data for a limited period (up to 30 days) for abuse monitoring before deleting it. The provider's processing of this data is governed by its own terms and privacy practices. You can request the identity of our current AI provider by contacting us at hello@askkazmo.com.
5. How We Share Your Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only in the following limited circumstances:
Service Providers. We share data with trusted vendors who help us operate the App, each bound by contract to protect it and to use it only on our instructions (except where they act as independent controllers, noted below):
- A third-party AI model provider — powers Kazmo's conversational responses.
- Creem — our Merchant of Record and payment provider for purchases made on our website. Creem acts as an independent controller for the payment transaction.
- Apple and Google — for purchases made through the Apple App Store or Google Play, which they process under their own terms.
- Google Analytics 4 and Google Tag Manager, PostHog, and GrainQL — analytics, session-replay, and tag-management providers that help us understand and improve how the App is used.
- Supabase — authentication and backend hosting for the App; data may be processed on Supabase infrastructure outside your country, including in Singapore.
- Cloudflare — content delivery, performance, and traffic-security services for our website.
Legal Requirements. We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Digital Macaroni, our users, or others.
Business Transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.
6. Payments
Website purchases. Payments made on our website are processed by Creem, our Merchant of Record. Creem is the seller of record and collects and processes your payment and billing information. We do not receive or store your full payment card details.
In-app purchases. Purchases made through the Apple App Store or Google Play are processed by Apple or Google under their own terms and privacy policies; we do not receive your payment card information for these transactions. Prices for in-app purchases may be higher than on our website to account for the platform fees charged by Apple and Google.
7. Data Retention
Account and Birth Data. We retain your account information and birth data for as long as your account is active, because they are required for the App to function and to generate your daily content. We delete them when you delete your account, except where we are required to retain certain records by law.
Conversations. Your conversations with Kazmo are retained for up to thirty (30) days and are then automatically deleted from our systems. Data already sent to our AI provider is handled under that provider's terms.
Card Collection. Short summaries associated with your collectible cards are retained as part of your collection for the life of your account.
8. Data Security
We implement reasonable technical and organizational measures designed to protect your personal information against unauthorized access, loss, destruction, or alteration. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
9. International Data Transfers
We are based in the United States, and your information may be stored and processed in the United States and in other countries where we or our service providers operate. These countries may have data-protection laws that differ from those in your country. Where required, we rely on appropriate safeguards for international transfers, such as the European Commission's Standard Contractual Clauses and, where applicable, the EU–U.S. Data Privacy Framework.
10. Children's Privacy
The App is intended for users aged 13 and older. It is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly. In some regions (including the EEA and the UK), a higher minimum age of digital consent may apply (between 13 and 16, depending on the country); where it does, users below that age must have the consent of a parent or guardian. 11. Your Rights and Choices
Depending on where you live, you may have some or all of the following rights regarding your personal data:
- Access — request a copy of the personal data we hold about you
- Correction — request correction of inaccurate or incomplete data
- Deletion — request deletion of your personal data
- Portability — request a copy of your data in a portable, machine-readable format
- Restriction / Objection — restrict or object to certain processing
- Withdraw consent — withdraw consent where we rely on it, without affecting prior processing
- Opt out — opt out of non-essential communications
To exercise any of these rights, contact us at hello@askkazmo.com. We will respond within the time required by applicable law. We will not discriminate against you for exercising your rights.
Deleting your account. You can delete your data at any time using the "Delete my data" option within the App, or by emailing hello@askkazmo.com. When you make a request, we send you a confirmation email and complete the deletion within seven (7) days, after which you receive a follow-up confirmation. Deletion removes your account information, birth data, conversations, and card collection, subject to limited legally required retention. Data already sent to our AI provider is deleted under that provider's retention practices described in Section 4.
12. U.S. State Privacy Rights
If you are a resident of California or another U.S. state with a comprehensive privacy law (including, for example, Colorado, Connecticut, Texas, Virginia, Oregon, and others), you may have the rights to know/access, correct, delete, and obtain a portable copy of your personal information, and to appeal a denial of a request. We do not sell your personal information or share it for cross-context behavioral advertising, and we do not use or disclose sensitive personal information for purposes that would require us to offer a right to limit. 13. EEA, UK, and Switzerland
If you are in the EEA, the UK, or Switzerland, you have the rights described in Section 11 above under the GDPR and equivalent laws. You also have the right to lodge a complaint with your local data protection supervisory authority. To exercise your rights, contact us at hello@askkazmo.com.
14. Cookies, Analytics, and Tracking
On the web, we and our analytics providers use cookies and similar technologies to operate the App, remember your settings, and understand usage. In our mobile apps, we use software development kits (SDKs) for similar purposes. Where required by law, we ask for your consent before setting non-essential cookies or analytics, and you can change your choices at any time. You can also manage cookies through your browser settings; disabling some cookies may affect how the App works. We do not currently respond to browser "Do Not Track" signals.
15. Third-Party Links and Services
The App may link to or integrate with third-party services. This Privacy Policy does not apply to those services, and we encourage you to review their privacy policies.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of material changes through the App or by email and will update the "Effective Date" above. Your continued use of the App after changes take effect constitutes acceptance of the updated policy.
